1. Definitions

In these Terms of Service, the following terms have the meanings set forth below:

• "Platform" - The Oswald Verse website, application, and all related services accessible at oswaldverse.com
• "User" - Any individual who accesses or uses the Platform, whether registered or not
• "Account" - A registered user profile on the Platform
• "Content" - Any text, images, stories, comments, votes, or other materials posted on the Platform
• "User Content" - Content created and submitted by Users
• "Tokens" - Virtual currency used within the Platform for voting and other features
• "Premium" - Paid subscription tier offering additional features
• "We, Us, Our" - Oswald Verse platform operators

2. Acceptance of Terms

By accessing and using Oswald Verse, you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and Oswald Verse.

3. Age Requirements

By using the Platform, you represent and warrant that:

• You are at least 13 years of age
• If you are under 18, you have obtained parental or guardian consent to use the Platform
• You have the legal capacity to enter into this agreement in your jurisdiction

If we discover that a user is under 13, we will immediately terminate their account and delete their personal data in accordance with our Privacy Policy.

4. User Accounts

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You are responsible for safeguarding your account credentials. We are not liable for any loss or damage arising from your failure to protect your account.

One person may maintain only one account. Creating multiple accounts to circumvent restrictions or abuse features is prohibited.

5. Use License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Platform for personal, non-commercial purposes
• Read and interact with stories published on the Platform
• Create, publish, and share your own stories and content
• Participate in voting, commenting, and community features

This license does not include:

• Modifying, copying, or distributing Platform software or code
• Using automated systems (bots, scrapers) to access the Platform
• Reverse engineering any part of the Platform
• Commercial use without explicit written permission

6. Intellectual Property Rights

6.1 Platform Content

The Platform, including its design, features, software, and branding, is owned by Oswald Verse and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or branding without prior written consent.

6.2 User Content Ownership

You retain full ownership of all original content you create and publish on Oswald Verse. This includes stories, characters, worlds, and creative works.

6.3 License to Us

By posting content on the Platform, you grant Oswald Verse a worldwide, non-exclusive, royalty-free license to:

• Display, distribute, and promote your content on the Platform
• Store and backup your content on our servers
• Format and adapt content for different devices and displays
• Use excerpts for promotional purposes (with attribution)

This license terminates when you delete your content or account, except for content that has been shared, commented on, or is part of collaborative stories (which may remain in anonymized form for platform integrity).

7. Prohibited Uses

You agree not to use the Platform to:

• Violate any applicable laws, regulations, or third-party rights
• Post illegal, harmful, threatening, abusive, or harassing content
• Impersonate any person or entity, or falsely represent your affiliation
• Post spam, advertisements, or unsolicited promotional material
• Upload malware, viruses, or other harmful code
• Attempt to gain unauthorized access to any part of the Platform
• Interfere with or disrupt the Platform's operation
• Collect or harvest user data without consent
• Circumvent any access restrictions or security measures
• Use the Platform for any commercial purpose without authorization

Content Restrictions

The following content is strictly prohibited:

• Content that exploits or endangers minors
• Explicit sexual content involving real people without consent
• Content promoting violence, self-harm, or illegal activities
• Hate speech or content targeting protected groups
• Content that infringes copyrights, trademarks, or other IP rights
• Private or confidential information of others

8. Content Moderation Policy

We reserve the right to review, edit, or remove any content that violates these Terms or our community guidelines. Moderation decisions may include:

• Content Removal - Deleting content that violates our policies
• Content Warning - Adding labels to content that may be sensitive
• Account Warning - Notifying users of policy violations
• Temporary Suspension - Restricting account access for a defined period
• Permanent Ban - Terminating accounts for severe or repeated violations

You may appeal moderation decisions by contacting us at support@oswaldverse.com within 30 days. We aim to review appeals within 14 business days.

We are not obligated to monitor all content but may do so at our discretion. Users can report violations using the report feature or by contacting support.

9. Account Termination

9.1 By You

You may delete your account at any time through your Privacy Settings:

• Your account enters a 30-day recovery period (soft delete)
• You can restore your account within this period by logging in
• After 30 days, your personal data is permanently deleted
• Published content may be anonymized but preserved for platform integrity

9.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activity
• Abuse other users or the Platform
• Fail to pay for Premium services (after reasonable notice)
• Create multiple accounts to circumvent restrictions

For serious violations, we may terminate accounts immediately without notice. For less severe violations, we will typically provide a warning first.

10. Payments and Subscriptions

10.1 Premium Subscriptions

Premium subscriptions are billed through Stripe and:

• Are charged monthly or annually, depending on your selection
• Automatically renew unless cancelled before the renewal date
• May be cancelled at any time through your account settings
• Provide benefits until the end of the current billing period after cancellation

10.2 Token Purchases

Tokens are virtual currency with the following terms:

• Tokens have no monetary value and cannot be exchanged for cash
• Unused tokens do not expire while your account remains active
• Tokens are non-transferable between accounts
• Token purchases are final and non-refundable

10.3 Refunds

We offer refunds within 14 days of purchase if you have not used the purchased service or tokens. Contact billing@oswaldverse.com.

11. Disclaimer of Warranties

We specifically disclaim all implied warranties including:

• Merchantability - We do not warrant that the Platform is fit for any particular purpose
• Fitness for Purpose - We do not guarantee the Platform meets your specific requirements
• Non-Infringement - We do not warrant that the Platform does not infringe third-party rights
• Availability - We do not guarantee uninterrupted, secure, or error-free operation

Some jurisdictions do not allow disclaimer of implied warranties. In such cases, the above disclaimers may not apply to you.

12. Limitation of Liability

Our total liability to you for any claims arising from or related to these Terms or your use of the Platform shall not exceed the greater of:

• The amount you paid to us in the 12 months preceding the claim, or
• €100 (one hundred euros)

This limitation applies to:

• Any damage to your computer, device, or data
• Any loss resulting from content posted by other users
• Any interruption or cessation of Platform services
• Any unauthorized access to your account
• Any other matter relating to the Platform

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, the above limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Oswald Verse and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Content you post on the Platform
• Any dispute between you and another user

14. Dispute Resolution

14.1 Informal Resolution

Before initiating formal proceedings, you agree to attempt to resolve any dispute by contacting us at legal@oswaldverse.com.

14.2 Jurisdiction

If informal resolution fails, disputes shall be resolved by the courts of Poland. For consumers in the European Union, this does not affect your right to bring proceedings before the courts of your country of residence.

14.3 EU Online Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform for EU consumers: https://ec.europa.eu/consumers/odr

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

If you are a consumer residing in the European Union, you additionally benefit from the mandatory provisions of consumer protection laws in your country of residence.

Nothing in these Terms affects your statutory rights as a consumer under applicable EU consumer protection legislation.

16. Changes to Terms

We may modify these Terms at any time. When we make changes:

• Notification - We will notify you via email and/or prominent notice on the Platform at least 30 days before changes take effect
• Material Changes - For significant changes affecting your rights, we will request explicit consent
• Last Updated Date - The date at the top of this page will be updated
• Previous Versions - Available upon request from legal@oswaldverse.com

Your continued use of the Platform after the changes take effect constitutes acceptance of the modified Terms, unless explicit consent is required.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

18. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of Oswald Verse.

19. Entire Agreement

These Terms of Service, together with our Privacy Policy & Cookie Policy, constitute the entire agreement between you and Oswald Verse regarding your use of the Platform. These Terms supersede any prior agreements, communications, or understandings between you and Oswald Verse, whether written or oral.
